AWRA learned on Oct. 27th that, last June, Timbercreek Equities Corp./Hazelview Investments submitted a 'case application' to the Ontario Land Tribunal (OLT) regarding their Thornhill Square development proposal.
Timbercreek/Hazelview was able to submit this application to the OLT because the City failed to make a decision regarding the requested Official Plan Amendments and Zoning By-Law Amendments within the time limits set by the Planning Act.
What This Means:
Excessive Development Threatens to Negatively Impact our Neighbourhood & Our Quality of Life!
It is no longer within the power of the City of Markham to make a decision with respect to the Hazelview/Timbercreek proposal. The OLT now has the power to decide at (or after) the December 1st CMC hearing, the future of the proposed Thornhill Square development. Their decision will be based on the discussion with the parties (the developer and The City of Markham) and written statements from other participants.
Since we received the notice of the CMC hearing at the last possible 'legal' time, we do not have the time to raise the funds to pay for a lawyer and to qualify as a "Party" at the hearing. However, AWRA will definitely be a "Participant."
